Terms and conditions

1. The Promoter
The Promoter is: The Big Table Group Limited (12631102) trading as Banana Tree with registered address at Lower Ground Floor, Elsley House, 24/30 Great Titchfield Street, London, W1W 8BF.

2. The competition
The title of the competition is “Take me to Thailand”. Sign up and enter to win a holiday to Thailand, subject to these terms and conditions.

3. How to enter
3.1 The competition will run from 12th August 2024- 22nd September 2024 (the Closing Date) inclusive.
3.2 All competition entries must be received by the Promoter by no later than 9pm on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
3.3 To enter this competition, you must visit a Banana Tree Restaurant (excluding Banana Tree Stevenage) between 12th August and 22nd September and order any one of the following drinks: Sex on the Beach, Mai Thai and Wild Strawberry Sparkler (non-alcoholic). You will receive a scratch card with your drink which will give you a chance to enter the competition. To enter, you must scan the QR code on the scratch card and enter your details on the online entry form. You will receive a confirmation email upon successful entry. Please note your information will be processed in accordance with our Privacy Policy https://bananatree.co.uk/privacy-policy.
3.4 The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind
3.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

4. Eligibility
4.1 The competition is only open to all residents in the UK aged 18 years or over, except for employees of the Promoter or its holding or subsidiary companies, or members of their immediate families or households.
4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.
4.3 The Promoter will not accept competition entries that are:
(a) automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
(b) completed by third parties or in bulk;
(c) incomplete.
Entries on behalf of another person will not be accepted and joint submissions are not allowed. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

5. The prize
5.1 The prize is a 1 X travel voucher for one winning customer, to the value of £3,615 + VAT which shall be provided by Pernod Richard (UK) Limited, with company number 01870414 and registered address at Building 7 Chiswick Park, 566 Chiswick High Road, London, United Kingdom, W4 5YG.
5.2 Following the closure of the competition, The Big Table Group shall securely share with Pernod Richard, the name, email address and contact number of the winner. From this point, Pernod Richard shall liaise fully and directly with the winner in the provision of the Prize and your personal information will be processed in accordance with Pernod Ricard’s Privacy Policy as set out under Clause 10.2.
5.3 The Big Table group shall hold no liability whatsoever in terms of the provision of the Prize.
5.4 The Prize is one travel voucher that shall be for 2 people and include the following:
• Return flights from London to Phuket
• Return private airport transfers in Phuket
• 5 nights’ luxury (4* min) hotel accommodation in Phuket, based on sharing a double/twin room
• Daily breakfast
• Travel insurance
• Winner management
• Travel prizes in UK and abroad protected- Element London ATOL 10207/ABTOT 5467
5.5 You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified. Dates once notified to the travel agent cannot be changed.
5.6 There is no cash alternative for the prize. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so. The prize is not negotiable or transferable.

6. Winners
6.1 The winner will be chosen at random and will be notified by email. In order to claim the prize you must respond within 7 days of being chosen. The decision of the Promoter is final and no correspondence or discussion will be entered into. The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry.
6.2 The Promoter must either publish or make available basic information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners on the 27th September 2024.
6.3 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter and Pernod Richard UK Limited. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

7. Claiming the prize
7.1 If you are the winner of the prize, you will have 7 days from the Announcement Date to respond to notification by email and claim the prize. If you do not claim the prize by this date, your claim will become invalid. The prize may not be claimed by a third party on your behalf.
7.2 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 7 days, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date. The Promoter does not accept any responsibility if you are not able to take up the prize.

8. Limitation of liability
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. Ownership of competition entries and intellectual property rights
You agree that the Promoter may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry for such purposes.

10. Data protection and publicity

10.2 The Promoter will be required to share the name and email address of the winner of the competition with the prize provider, Pernod Ricard UK Limited. Pernod Ricard UK Limited will process your personal information in accordance with their privacy policy https://www.pernod-ricard.com/en/locations/uk/terms-use-and-privacy-policy.

11. General
11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
11.2 These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
